The End of the Outbreak Period and a Refresher on Wellness Programs
The federal government plans to end much of the relief provided for under the original declaration of the COVID-19 National Emergency made on March 13, 2020. On May 4, 2020, the federal government also released a notice that extended certain timeframes during the COVID-19 National Emergency declaration and subsequent Outbreak Period that affect both plan sponsors and plan participants of group health & welfare plans subject to ERISA and the Internal Revenue Code. With the upcoming end of the National Emergency and Outbreak Period, many employers/plan sponsors will need to review the status of their current plan to ensure compliance with many of the rules employee health & welfare benefit plans will be subject to after the end of the National Emergency and related Outbreak Period.
