This article provides more in-depth information on the regulations\u2019 requirement to report on wellness spending, as detailed in the <a href=\"https:\/\/www.cms.gov\/sites\/default\/files\/2021-12\/RxDC-Reporting-Instructions.pdf\" target=\"_blank\" rel=\"noopener\">CMS\u2019 Prescription Drug Data Collection (RxDC) Reporting Instructions<\/a>.<\/p>\n<h3>The Wellness Program Component of the Rx Drug Reporting Requirement<\/h3>\n<p>As we mentioned in our previous article, health plans must report much more than prescription drug pricing under the Rx drug reporting requirement. Specifically, the reporting must also include data related to the health plan\u2019s total annual spending on health care services. Spending on wellness programs is included as part of health care services. <a href=\"https:\/\/www.ecfr.gov\/current\/title-29\/subtitle-B\/chapter-XXV\/subchapter-L\/part-2590\/subpart-D\/section-2590.725-4\" target=\"_blank\" rel=\"noopener\">DOL Reg. \u00a72590.725-4 provides as follows<\/a>:<\/p>\n<p style=\"padding-left: 40px;\">(b) Information for each state and market segment. The report required under \u00a7 2590.725\u20132 must include the following information with respect to plans or coverage for each State and market segment for the reference year unless otherwise specified:<\/p>\n<p style=\"padding-left: 40px;\">(4) Total annual spending on health care services by the plan or coverage and by participants and beneficiaries, as applicable, broken down by the type of costs, including\u2014<\/p>\n<p style=\"padding-left: 40px;\">(i) Hospital costs;<\/p>\n<p style=\"padding-left: 40px;\">(ii) Health care provider and clinical service costs for primary care and specialty care separately;<\/p>\n<p style=\"padding-left: 40px;\">(iii) Costs for prescription drugs, separately for drugs covered by the plan\u2019s or issuer\u2019s pharmacy benefit and drugs covered by the plan\u2019s or issuer\u2019s hospital or medical benefit; and<\/p>\n<p style=\"padding-left: 40px;\">(iv) Other medical costs, including <strong>wellness services<\/strong>.<\/p>\n<p>Notably, the regulations do not define \u201cwellness services,\u201d do not detail what costs must be reported as part of the \u201cother medical costs\u201d category and do not discuss the details of the requirement to report wellness-related expenses.<\/p>\n<p>However, the requirement is described in further detail in <a href=\"https:\/\/www.cms.gov\/sites\/default\/files\/2021-12\/RxDC-Reporting-Instructions.pdf\" target=\"_blank\" rel=\"noopener\">CMS\u2019 Prescription Drug Data Collection (\u201cRxDC\u201d) Reporting Instructions<\/a>. The RxDC Reporting instructions provide that necessary reporting for \u201cwellness services\u201d consists of \u201cexpenses for activities primarily designed to implement, promote, and increase health and wellness and not billed as a claim.\u201d While the definition is quite vague, presumably to capture the varied nature of employer wellness programs, the instructions list the following specific examples:[\/vc_column_text]\t<div class='wpb_content_element text-left btn-container'>\n\t\t\t\t\t<a class='btn btn-brand-green  '\n\t\t\t\thref='https:\/\/bbrown.com\/wp-content\/uploads\/2022\/08\/No-Surprises-Act-Prescription-Drug-Reporting-Wellness-Program-Component-Brown-Brown.pdf' target='_blank' data-toggle=''>\n\t\t\t\t<span class=\"btn-text-color--default\">Continue Reading<\/span>\n\t\t\t<\/a>\n\t\t\t<\/div>\n[\/vc_column][vc_column width=&#8221;1\/3&#8243;][vc_single_image image=&#8221;1390&#8243;
